Is the Building Safety Act Unintentionally Creating Greater Risks for Traditional Buildings?

One of the biggest misconceptions surrounding the Building Safety Act is that it only affects high-rise residential buildings. That is not really true. Yes, parts of the legislation specifically focus on Higher-Risk Buildings and high-rise residential blocks,  but the wider impact goes far beyond towers and apartment blocks.

The Act is fundamentally changing building control culture, accountability, competence expectations, retrofit decision-making, and how compliance is demonstrated across the construction sector. That matters enormously for traditional buildings, which represent around 21% of homes and 33% of non-residential properties in England alone.

Why Traditional Buildings Behave Differently

Traditional buildings do not behave like modern construction. To remain healthy and durable, they rely on vapour permeability, natural ventilation, evaporation, and moisture movement through the building fabric.

Rather than being design quirks, these are the essential mechanisms that keep solid-wall, moisture-sensitive structures free from decay.

The post-Grenfell compliance environment, however, increasingly favours certified systems, approved details, standardised retrofit approaches, and procedurally defensible solutions. A technically compliant solution is not always a technically appropriate one, particularly for solid-wall construction, historic buildings, or vapour-permeable structures.

This is particularly serious because traditional buildings often fail slowly. Problems may not become visible until years after retrofit work has been completed, long after the contractor has left and liability has become murky.

Failed Retrofit Case Study: Caerau, Bridgend County

A 2012 retrofit project to 104 houses in Caerau, Bridgend County, cost about £300,000 and illustrates exactly what is at stake.

External and internal wall insulation was applied without adequate consideration of how the existing solid-wall fabric managed moisture. This led to issues including damp, mould, freezing indoor temperatures, and damage to interiors.

The repair bill to this failed retrofit project was estimated to be around £1m, according to the BBC.

A small cottage, farmhouse, terrace or converted historic building may never fall within the formal Higher-Risk Building regime. But the professionals working on those buildings are increasingly operating within a compliance culture shaped by the Act, one that now places far greater emphasis on certification, traceability, documented evidence, and low-risk procedurally defensible solutions.

The concern now is whether increasingly rigid compliance systems and reliance on certified approaches may unintentionally reduce the space for informed professional judgement, building pathology, and technically appropriate traditional-building solutions.
